Andrew Carafelli received a complete defense verdict on behalf of a national Railroad after a week- long jury trial in Denver District Court. The plaintiff had brought suit pursuant to the Federal Employers Liability Act ( “FELA”) claiming that the Railroad was negligent in allowing a passenger to strike her ankle with a roller bag causing her to fall to the ground thereby causing her serious injuries which prevented her from ever returning to work. Specifically, plaintiff claimed that the Railroad caused “chaos” on the platform at Union Station which had in turn caused the passenger to strike her with his roller bag. Mr. Carafelli argued that not only was there no chaos on the platform, but that plaintiff had failed to prove she was unable to work in any capacity, whatsoever. The jury found that the Railroad was not negligent as alleged by plaintiff.
